To better motivate Creators (defined below) to upload high-quality models and content to MakerWorld and to build an interactive and cohesive community with their commercial Subscribers (defined below), MakerWorld ("we," "us," "our," or "MakerWorld") has established this Membership Program (the “Program”). This Program will be open to eligible Creators and Subscribers, subject to the terms and conditions of this MakerWorld Membership Program Agreement (“Agreement”). Creators who participate in this Program may be entitled to earn income from Subscriptions offered to Subscribers and other benefits as further described in this Agreement. Subscribers may be entitled to use Creator’s Program Models for commercial purposes or under license terms set forth by the Creator.
Creators and Subscribers that participate in this Program are urged to thoroughly read and understand this Agreement and the conditions and rules applicable to the Program before applying or subscribing. By applying to become a Creator or Subscriber, or by participating in the Program, you hereby agree and consent to be bound by all the provisions of this Agreement, as well as all the terms and conditions of the Terms of Use of MakerWorld and Community Guideline, and you acknowledge that you have read and understand our Privacy Policy.
This Agreement constitutes an integral part of the Terms of Use of MakerWorld and Community Guideline and has equal legal effect. The Creator must adhere to the Terms of Use of MakerWorld and Community Guideline while utilizing our services when participating in the Program. In instances where this Agreement does not specify or is unclear, the provisions of the Terms of Use of MakerWorld and Community Guideline shall prevail. Should any provision of this Agreement conflict with the Terms of Use of MakerWorld and Community Guideline, the provisions of this Agreement shall take precedence.
This Agreement includes the main body of the agreement, its appendices, any written Program notices, rules, or disclosures that have been or may in the future be issued by MakerWorld concerning the Programs that are referenced in this Agreement (e.g. cancellation or pricing terms). All components described in this section 1.3 are inseparable components of this Agreement and have the same legal effect as the main body of the Agreement.
MakerWorld reserves the right at any time to change, establish, or modify (a) the Membership Program, (b) this Agreement or any rules or other portions of it. Changes to this MakerWorld shall notify the Creator and User of any change to the Agreement at least 7 days before the effective date of the updated Agreement, by publishing the updated Agreement through in the MakerWorld Platform, for example and without limitation, on MakerWorld’s website or by means of a message sent to the Creator registered e-mail address. Unless mandatory provisions of laws or regulations stipulate otherwise, the amended Agreement shall automatically take effect once published, and will at that time become part of this Agreement. The Creator and User’s continued participation in the Program after such modifications take effect shall be regarded as their acceptance of the amended Agreement.
MakerWorld reserves the right at any time to suspend or terminate without further obligation to the Creator and User: (a) the Membership Program, or (b) this Agreement. Upon termination of this Program or this Agreement, the Creator and User will have 30 calendar days (or such other period as specified by MakerWorld at the time of termination, "Grace Period") to continue accessing subscriptions. Following the Grace Period, all Subscriptions in the User’s account will be canceled.
Any Creator and Subscriber participating in this Program must be at least the minimum age required to form a binding contract (the age of majority) under the laws applicable where the Creator or Subscriber reside, or 18 years of age, whichever is older.
Creator means a user who wishes to create Subscription and Membership Levels for other Subscribers.
For Creators and Subscribers using the MakerWorld at makerworld.com, “MakerWorld” refers to MakerWorld Singapore Pte. Ltd.
A 3D model (e.g. .3mf, .STEP, or .STL) file that is made available to Subscribers through the Program as part of a Subscription.
Standard Digital File License means the Standard Digital File License as described on the MakerWorld license page.
Subscriber means a User that subscribes to be member of a Creator’s Subscription, consistent with any applicable Subscription requirements.
A Subscription refers to the offering of User Content or other features or benefits by a Creator to Subscribers under the Program.
A category or level of Subscription defined by the Creator with different offerings or benefits for Subscribers, e.g. revenue limits for certain Memberships.
To participate in this Program and offer Subscriptions, a Creator must meet the eligibility requirements described in this section 3 ("Eligibility Requirements"), apply to the Program, and remain qualified at all times during participation in the Program. MakerWorld reserves the right to admit Creators (or revoke admission) to the Program at MakerWorld’s sole discretion. Eligibility Requirements are subject to change as described in the above section 1.4. Creators may be required to meet any new Eligibility Requirements to continue to participate in the Program.
The Programs are open to MakerWorld Creators whose accounts meet requirements below:
Account levels have reached at least 15.
Followers are at least 200.
Total accumulated model prints have reached at least 600.
Accounts do not have any histories of violating Terms of Use of MakerWorld or Community Guideline within 90 days of application.
The Creator shall ensure the models and other content being uploaded are original or authorized work, or the Creator must have obtained all rights, licenses (including exclusivity rights), permissions, consents, and releases from the lawful rights holder that are necessary to participate in the Membership Program and offer any licenses to the Program Model to Subscribers.
All models must conform to our Community Guidelines, this Agreement, and must comply with all applicable laws, rules, and regulations. Your model and participation in a Program must not cause MakerWorld to violate any laws, rules, or regulations, including without limitation any export control requirements.
Creators who join the Membership Program may establish Creator-defined Membership Levels. A maximum of three Membership Levels may be created, each with a Creator-defined Subscription scheme for Subscribers. Creator Earnings, Transaction Fees, Platform Fees (each as defined below), and other related matters are subject to the most current policies of MakerWorld and its payment processor and other service providers (as applicable). MakerWorld may, at its sole discretion, modify Creator Earnings, Transaction Fees, Platform Fees, and other fees or related policies, with or without notice, except where otherwise required by law. Please note that fees imposed by financial institutions, payment processors, or service providers associated with payment instruments are outside our control and not applied by us, and may change at any time, without notice.

Creators may define their Membership Levels with self-determined license terms, except to the extent otherwise provided in this Agreement, the Terms of Use for MakerWorld, or the Community Guidelines.
Notwithstanding Section 4.2.1 or any term of the Exclusive Model Program Agreement, with respect to Program Models that are also enrolled in the Exclusive Model Program (as defined in the Exclusive Model Program Agreement) ("Exclusive Program Models"), Creators may modify the Standard Digital File License to permit certain uses of Program Models by Subscribers during the term of any Subscription, in the Creator’s discretion, provided that Creators may not authorize Subscribers to sub-license, sell, rent, host, transfer, or distribute on or through any third party platform or service (“Prohibited Commercial Uses”) the Exclusive Program Model, or any derivative work of the Exclusive Program Model other than Subscribers’ physical 3D printed works . In other words, Subscribers are free to sell 3D printed works based on an Exclusive Program Model, but Creators are not allowed to permit distribution of Exclusive Program Models on third party sites, or otherwise allow subscribers to sell or license the model to third parties while taking part in the Exclusive Model Program.
All Program Models are directly licensed by the Creator to Subscribers. MakerWorld does not grant, whether directly, indirectly, or on behalf of any Creator, any license or sub-license to Subscribers for any Program Models. Creators are solely responsible for defining and enforcing licenses to Program Models.
Creator can not self-determine the license period and the license period will align with the Billing Cycle of each Subscribed User.
Creators may modify or terminate any license to any Program Models or other Subscriber benefits for a Subscriber Level, provided that changes for existing Subscribers must only take effect at the end of the Subscriber’s then-current Subscription period following notice of such modification or termination, and in no event less than 30 days. Any changes may take effect immediately for Subscribers who enter into a Subscription after the date on which any modifications are made.
If a Creator wishes to remove a Membership Level, the corresponding Membership Level will be deleted immediately if there are no current Subscribers.
If there are Subscribers for the Membership Level, it will become inaccessible and inactive to unsubscribed Subscribers, and all Subscribed Subscribers' auto-renewing subscriptions will be canceled, but the Membership Level will remain unaffected through the end of the Subscriber’s Subscription term. At the end of each Subscriber’s Subscription term, the Subscription will expire, and the Membership Level will be made unavailable.
MakerWorld may keep the records of Membership Levels and Subscriptions and may keep other records relating to Creator’s Subscriptions in connection with our legal obligations. You authorize our collection of any data necessary to create appropriate records, process payments, conduct due diligence, enforce this Agreement, and otherwise exercise our rights and perform our obligations under this Agreement. Personal Data will be collected and processed as further described in the MakerWorld Privacy Policy.
Creators will earn income based on payments successfully collected from Subscribers for each Subscription made in accordance with this Agreement (“Subscriber Fees”), less applicable Platform Fees, Transaction Fees, taxes, Redemption Fees, and other costs or expenses specified in this Agreement or other Program materials (“Creator Earnings”). See here for information regarding applicable deductions.

After a Subscriber subscribes and pays the Subscription Fee, a 30-day hold-back period will apply for all Creator Earnings earned from that subscription. This hold-back period is designed to ensure that the Subscriptions are authentic, that the Creator and Subscriber did not engage in fraudulent activities or violations of this Agreement in connection with a Subscription, and that the Subscriptions Fees have been paid and settled. Creator Earnings may only be processed once the hold-back period has ended and no Violations have been identified provided that there is no basis on which MakerWorld may void or deem such Creator Earnings as unearned under this Agreement.
MakerWorld, based on local regulations, and operational conditions, may independently determine limits on the payments that can be made in any given period or for any particular transaction.
Except where required by law, Creators are fully responsible for all tax obligations related to the Creator Earnings redeemed through MakerWorld’s wallet, including tax filing and payment . MakerWorld assumes no responsibility in this regard and is not obligated to compensate or reimburse any additional fees or penalties incurred by Creators due to tax-related matters (if applicable).
Additionally, MakerWorld will not be liable for any responsibilities related to the Creator’s legal business and tax obligations, such as tax reporting, payments, withholdings, fines, interest, or penalties, either to the Creator or any third party.
In order to comply with applicable law, we may perform due diligence (e.g. anti-fraud or anti-money laundering) checks on you as a condition of processing Creator Earnings. We may freeze or clawback Creator Earnings request where we believe we are prohibited from providing you with Creator Earnings or any violation of law. If requested (whether by MakerWorld or its service provider) you must provide complete, accurate, and up to date information at all times, including any information required to comply with the law. You will promptly provide any additional information, at the latest within two (2) business days of any request. You acknowledge that we may not payment of Creator Earnings until we have received all the information we require, and payments may be terminated if information is not provided in a timely manner. We will not be responsible for any loss arising out of your failure or delay in providing us with the information we require. You agree that MakerWorld may make, directly or using a third party service provider, any inquiries we believe are necessary to verify information you provide, including checking commercial databases or credit reports, before we request or permit the issuance of Creator Earnings. We may keep records of our due diligence checks in accordance with applicable law.
If a Subscriber disputes the payment of Subscription Fees, those Subscription Fees may be deemed unearned due to violations and you may see a reduction in your Creator Earninings, and your Creator Earnings balance may become negative. MakerWorld may recover the negative balance from future Creator Earnings.
Creators will not earn, and MakerWorld may void Creator Earnings, or otherwise block or withhold access to Creator Earnings as further described in Section 4.11.
All prices on MakerWorld in US Dollars. The supported currencies, and value of Subscription Fees, and estimates and payments of Creator Earnings in other currencies will be based on the available currencies and exchange rates offered by MakerWorld’s payments service provider. MakerWorld will use reasonable efforts request conversions and payment Creator Earnings in your desired currency, but makes no representation or warranty regarding available currencies or exchange rates. The actual exchange rate applied to your conversions will be determined exclusively based on the rate offered to MakerWorld by MakerWorld’s financial services provider when the request to redeem the Creator Earnings is fulfilled. Exchange rates are final and may not be contested for any reason.
MakerWorld makes no representation or warranty regarding the timeliness of payment of Creator Earnings, and you acknowledge that payment processors, legal obligations, and other matters outside the control of MakerWorld may result in payment delays. MakerWorld shall not be liable for any delay or failure to remit Creator Earnings due to events outside the reasonable control of MakerWorld, including but not limited to fire, explosion, natural disasters, strikes, labor disputes, legal restrictions, governmental orders, or transportation disruptions.
The Creator's Program Model shall be of high quality,and meet our Community Guidelines. Please review the Guidelines carefully to ensure that your Program Models meet our requirements. MakerWorld may, but is not obligated, to review each Program Model to ensure it conforms to our Community Guidelines.
By creating a Subscription, you enter into a contractual relationship directly with the Subscriber, including the license to any Program Model, and delivery or and products or services associated with the Subscription. You are solely responsible for the terms and content of that contract and your performance under that contract.
MakerWorld is not and will not be made a party to any contract between you and the User with respect to a Subscription. Any such agreement between you and a Subscriber that purports to make MakerWorld or Bambu Labs as a party is hereby deemed null and void.. MakerWorld is not obligated to review or verify your Subscriptions, licenses, or other promises to Subscribers, nor to ensure that the Program Model or other content provided aligns with the your commitments or the Membership Level.
MakerWorld is not responsible for, and will not be involved in, the resolution of any disputes between you and the User. You hereby agree that you will not bring or join MakerWorld in any dispute between you and a Subscriber, and you take all responsibility for any costs or fees, including attorneys’ fees, arising from or related to any attempt to bring MakerWorld into such a dispute.
Without limitation of any other provision of this Agreement, the following will be considered violations of the Program terms and this Agreement:
4.11.1 Non-Originality
If a Program Model is alleged to be a copy, clone, imitation, reproduction, duplicate, or otherwise non-original or non-authorized form as further described in section 6.2.1.
If you or your Program Model violates applicable laws, regulations, this Agreement, the Terms of Use of MakerWorld or Community Guidelines; violate any exclusivity arrangements (e.g. for Exclusive Program Models); or are alleged to breach your contracts with subscribers.
Any actual or alleged violations of a third party’s legitimate rights and interests, including intellectual property rights, and/or as a result of reports that allege or demonstrate violations of this Agreement, our Terms of Use, or Community Guidelines.
If you engage in unauthorized promotions or advertising, such as:
Lotteries, sweepstakes, contests, or other promotional activities without authorization;
Use of third party name, image, likeness or other personality rights without permission or violation of individuals’ privacy rights;
Violations of guidelines regarding paid promotions or endorsements; or
Guidence, external links or scan code to non-MakerWorld related businesses, organizations, online stores, or websites (other than those operated by or on behalf of or affiliated with the Creator).
If you are alleged to or actually engage in any fraudulent or malicious activities such as:
Account trading or unauthorized account transfers;
Falsifying transactions or data;
Inducing activities such as boosting, liking, rating, printing, downloading, collecting, or commenting in exchange for monetary or other form benefits;
Deliberately generating invalid or malicious traffic;
Duplicate or repetitive action in bad faith;
Any other form of cheating or deceptive behavior.
If you engage in any misrepresentation or fraudulent activities including but not limited to deepfakes, impersonation, bulk deletion in short time, or false or misleading information, or if you don’t make clear or accurate statements about your Subscription, Membership Level or Program Model.
If you may potentially harm the interests of other Subscribers or the community, as determined by evaluating the factors outlined in Section 4.12.
As further described in Section 9, and without limitation of MakerWorlds rights under the MakerWorld Terms of Use and Community Guidelines or applicable law, in the event of a violation described in sections 4.11.1 to 4.11.7 or any other breach of this Agreement, MakerWorld may, in its discretion: immediately pause or suspend your participation in the Program, terminate Subscriptions or Membership Levels, suspend or terminate your account, including your access to Creator Earnings, or remove your models from the Program or the MakerWorld Platform. MakerWorld also retains the right to cancel Subscriptions, Subscribers, and accounts for any reason, as described in Section 10. We may also block payment of Creator Earnings, or seek the return of Creator Earnings that have been withdrawn. In the meantime, the Membership Level may be suspended or removed from MakerWorld.
MakerWorld may also take the following actions depending on the specific violation:
(a) Restriction of Subscription, such as:
Pause. When a Membership Level is placed in pause status, it is under review by MakerWorld. During this time, the subscription can not be subscribed to by unsubscribed. Subscribers and the auto-renewal for Subscribers will be temporarily paused.
Removal. When a Membership Level is placed in remove status, it is deleted by MakerWorld. As a result, when a subscription cannot be subscribed to by unsubscribed subscribers, and the auto-renewal for subscribers will be canceled.
(b) Restriction of certain account functions, such as:
The Creator may be prohibited from uploading new models to MakerWorld;
The Creator’s account may be banned from applying to any or all MakerWorld special programs for 30 calendar days;
The Creator’s account may be permanently banned from applying for any or all special programs.
(c) Permanent closure of the account . In such cases:
All content and submissions including but not limited to models, models, print profiles, community posts, comments, ratings under the account will be removed from MakerWorld;
All points under the account will be revoked;
The account will no longer be able to upload models, or engage in any activities;
Any other effect of account termination is set forth in the MakerWorld Terms of Use.
In addition to the revocation procedures outlined in sections 4.11 above, in the event that any Creator Earnings is erroneously posted to a Creator’s account, MakerWorld reserves the right to have them removed from the Creator’s account, or request a return of any funds you withdraw that were unearned.
You may subscribe to an active Subscription by clicking the “Join” or other similar function displayed on the Creator or Membership Program’s page on MakerWorld. By subscribing, you hereby agree and consent to be bound by all the provisions of this Agreement and the license offered by the Creator. When your transaction is completed, you will receive a notice from MakerWorld.
5.2.1 When transaction is completed, you can exercise any license granted by the Membership Level.
5.2.2 Unless otherwise stated herein, the Creator has full discretion to establish the scheme, policies, and terms of the license associated with the Membership Levels, without any intervention from MakerWorld. MakerWorld does not grant any license or sub-license to Subscribers for any models or content. All models and content are provided directly by the Creator to the Subscribers.
5.2.3 Creators may modify or remove the license terms, license scope, or other Subsciber-only benefits of a Membership Level. Such changes will only take effect on subscribers of that Membership Level one month change. Subscribers may receive a notice and can review the differences implemented by the Creator.
5.2.4 The license period will align with the Billing Cycle of each Subscriber. You should respect all license terms of the Subscription.
The Subscription and current billing cycle will begin upon the completion of the payment transaction. All Subscriptions are auto-renewing. For so long as you have an active Subscription, your designated payment method will be automatically charged on the Billing Date. For monthly subscriptions, your “Billing Date” will be the same day of the month on which you initially subscribed (or the last day of the month, if earlier). Your subscription will remain active until you cancel it as described below.
You can view your current billing cycle and Subscription status from XXX. You are responsible for keeping your payment information up to date. If your payment method expires, your Subscription will terminate as though you cancelled a Subscription, and your rights to any Subscription may terminate.
When upgrading to a higher subscription level:
You’ll gain immediate access to the upgraded Membership Level and its benefit as soon as the payment transaction is completed. You will only be charged the price difference between levels, adjusted for the remaining days in your current billing cycle plus the price for next billing cycle. Your Billing Date will remain the same following the upgrade. On your next Billing Date, except next billing cycle, you will be billed at the new, higher price for the upcoming billing cycle.
When downgrading to a lower subscription level:
You will retain access to your current Membership Level until your next Billing Date, and your Billing Date will not change as a result of the downgrade. On your next Billing Date, you’ll be charged the new, lower price for the subsequent billing cycle.

Pause. When a Membership Level is placed in pause status, it is under review by MakerWorld. During this time, the subscription can not be subscribed to by unsubscribed,Subscribers and the auto-renewal for subscribers will be temporarily paused.
You may cancel your Subscription by visiting your MakerWorld account settings page at any time. Once you cancel your subscription or your Subscription becomes inactive, you won’t be charged for the next billing cycle. You will retain your current Membership Level and corresponding benefits until the end of your current billing cycle.
If you choose to restart your Subscription after canceling and your prior Subscription have not been expired, the former billing cycle and Billing Date will be maintained.
By subscribing to a Subscription, you are entering into a contractual relationship directly with the Creator of the Subscription, including the license to any models associated with it. You are solely responsible for understanding and complying with the terms of your licenses and agreements with creators.
MakerWorld does not grant any license or sublicense to Subscribers for any Program Models. Program Models are provided and licensed solely by the Creator.
MakerWorld is not a party to any contract between you and the Creator, and any contract between you and a Creator does not and will not bind MakerWorld.
MakerWorld may, but is not obligated to, review or verify the Subscriptions or Membership Levels offered, their respective conditions, the Program Models, or any other promises made by the Creator, to ensure that the content provided aligns with the Creator’s commitments or the Membership Level, or our Community Guidelines. You are solely responsible for reviewing and understanding your Subscription, licenses, and any other terms and conditions of that Subscription.
MakerWorld is not responsible for and will not be involved in, the resolution of any disputes between you and the Creator. You hereby agree that you will not bring or join MakerWorld in any dispute between you and a Creator, and you take all responsibility for any costs or fees, including attorneys’ fees, arising from or related to any attempt to bring MakerWorld into such a dispute.
MakerWorld shall not be liable for any delay or failure to perform under this agreement due to events outside of the reasonable control of MakerWorld, including but not limited to fire, explosion, natural disasters, strikes, labor disputes, legal restrictions, governmental orders, or transportation disruptions.
You can report any violations of this Agreement, our Community Guidelines by submitting MakerWorld Tickets.
Your Subscriptions may be paused or cancelled and your account suspended or terminated in MakerWorld’s sole discretion, including (without limitation) for the following violations:
If you are alleged to or actually violate any license to Program Models, or breach any of the terms of a Subscription or Membership Level, or of applicable laws or regulations, this Agreement, or the Terms of Use of MakerWorld or Community Guidelines.
Due to cheating activities such as:
Account trading or unauthorized account transfers;
Falsifying transactions or data;
Inducing activities such as boosting, liking, rating, printing, downloading, collecting, or commenting in exchange for monetary or other form benefits;
Deliberately generating invalid or malicious traffic;
Duplicate or repetitive action in bad faith;
Any other form of cheating or deceptive behavior.
Subscriptions may be removed for other violations that actually or potentially harm the interests of other Subscribers or the community, as determined by evaluating the factors outlined in Section 5.9.
Remove means the subscription will be terminated immediately and it will not be refund.
For violations under sections 5.8.1 to 5.8.3, MakerWorld may also take the following actions depending on the specific violation:
(a) Restriction of certain account functions, such as:
The Subscriber may be prohibited from uploading new models to MakerWorld;
The Subscriber's account may be banned from applying to any or all programs, including subscribing a subscription, for 30 calendar days;
The Subscriber 's account may be permanently banned from applying for any or all programs.
(b) Permanent closure of the account. In such cases:
All content and submissions including but not limited to models, print profiles, community posts, comments, ratings under the account will be removed from MakerWorld;
All points under the account will be revoked;
The account will no longer be able to log in, upload models, or engage in any activities.
MakerWorld will issue refunds in its sole and exclusive discretion, and will not be obligated to issue refunds unless required by law. Refunds may be conditioned, for example, on serious violations by the Creator being reported, confirmed, and concluded by MakerWorld in our sole discretion, and only if such refunds are permitted and feasible by the related third party service provider and such commissions have been withheld or clawed back.
6.1.1 It is an independent legal person established and validly existing in accordance with the laws of its registered place, or a natural person with full capacity to enter into this Agreement, and has the complete legal qualification and unimpaired capacity for rights to sign this agreement and fulfill all the responsibilities and obligations stipulated in this agreement.
6.1.2 The signing of this Agreement and the performance of their respective obligations under this Agreement will not violate any laws, regulations, articles of association, agreements, judgments, orders, or rulings that are binding on them, nor will they infringe on the legitimate rights and interests of any third party.
6.1.3 The execution and performance of this Agreement are business conduct, and all warranties and commitments made under this Agreement are continuous, valid, irrevocable, and enforceable.
6.2.1 The Creator has all necessary rights, title, and interest in and to the Program Model to grant the rights and licenses under this Agreement, and the Creator has obtained sufficient and effective authorization from the qualified rights holder, and has the right to authorize MakerWorld and its affiliates, and Subscribers, to use the Program Model in accordance with the provisions of this agreement and any licenses to Subscribers.
6.2.2 You are eligible under the laws of your jurisdiction to offer the Subscriptions and earn Creator Earnings, and you have made all necessary tax filings or reports required under applicable law.
6.2.3 The Program Model does not violate the provisions of laws, regulations, and normative documents, does not infringe on the legitimate rights and interests of any third party, such as intellectual property rights, reputation rights, privacy or personality rights, and does not violate applicable restrictions on social morality and public order.
6.2.4 That MakerWorld and its affiliates may display, disseminate, promote, recommend, and search any Program Model in accordance with the provisions of this Agreement without infringing on the legitimate rights and interests of any third party (including the rights and interests of third parties such as copyrights, trademarks, patents, and privacy or personality rights).
6.2.5 You will not harm the legitimate rights and interests of the MakerWorld Parties, and Subscribers.
Creators agree that a model will be considered "Non-Original" if it meets any of the following criteria, as determined by MakerWorld in its reasonable discretion:
(a)Copies, plagiarizes, or is a re-upload of another Creator’s model or otherwise infringes or misappropriates any intellectual property, privacy, or other rights of any third party throughout the world;
(b)Model is a remix or other derivative work of existing designs that may infringe the intellectual property rights of a third party; or
(c)Model violates applicable laws and regulations such as copyright law, trademark law, design law, patent law, or other third party rights and/or Community Guidelines, relevant policies, public order and good morals, or societal ethics or spamming low quality or repetitive models will result in ineligibility for the Membership Program..
6.4.1 Should MakerWorld have reasonable grounds to suspect that a model is Non-Original, the Creator shall provide, upon MakerWorld’s request documentation proving the originality of the model and the Creator’s identity (“Proof”).
6.4.2 If the Creator refuses to provide Proof, the Creator may lose the eligibility to participate in any or all program or, the offending models may be removed, points may be withdrawn, and/or MakerWorld may take any other actions stipulated in section 10 of this Agreement or the Terms of Use of MakerWorld.
6.5.1 Creators or their licensors retain ownership and all rights in their User Content and Program Models, except for the licenses granted to MakerWorld in connection with the Program. When you accept this Agreement, and each time you make a Program Model or other content available through MakerWorld in connection with the Program, the Creator hereby grants MakerWorld the following licenses:
Program Model License: As already provided by the Terms of Use of MakerWorld, a perpetual, non-exclusive, worldwide, royalty-free, transferable (e.g. as part of a corporate reorganization), sub-licensable (e.g. to our hosting providers), limited license to process, review and host the Program Model, display it on the MakerWorld Platform, and make it available to Subscribers via the MakerWorld Platform.
Model Collateral License: A perpetual, irrevocable, non-exclusive, worldwide, royalty-free, sublicensable, limited license to any descriptions, photos, drawings, videos, renderings, or branding or marketing materials, or any other content relating to or uploaded in connection with the Program Model or a Creator’s participation in the Program (but excluding the Program Model itself, “Model Collateral”) to use, copy, reproduce, store, translate, transmit, distribute, perform, prepare derivative works, publicly display, and display, whether alone or in connection with any name, username, voice, or likeness included within or related to any Model Collateral, in connection with the operation of the Platform and Program, distribution, promotion, and marketing of the Model, Program, MakerWorld, or Bambu Lab, including on official MakerWorld media and social media accounts, and all other channels, including without limitation, for the purpose of operating and promoting the services of MakerWorld and Bambu Lab.
6.5.2 Except for the licenses granted under this Agreement, the Creator retains all right, title, and interest in the Program Model and Model Collateral, and the parties retain all intellectual property and other rights it may have under applicable law. Any use of trademarks, service marks, or other marks , including Model Collateral, inures to the benefit of the owner of such marks.
TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, MAKERWORLD AND ITS AFFILIATES, EMPLOYEES, DIRECTORS, OFFICERS, SERVICE PROVIDERS, SPONSORS, CONTRACTORS AND AGENTS ("MAKERWORLD PARTIES") WILL NOT HAVE ANY LIABILITY (WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE), PRODUCT LIABILITY OR OTHER THEORY) FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, EVEN IF THE CREATOR OR WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY LOSS OF REVENUE, DATA OR PROFITS ARISING UNDER OR WITH RESPECT TO THIS AGREEMENT OR THE PROGRAMS. FURTHER, THE MAKERWORLD PARTIES’ AGGREGATE LIABILITY ARISING UNDER OR WITH RESPECT TO THIS AGREEMENT OR THE PROGRAMS WILL IN NO EVENT EXCEED THE AMOUNT OF CREATOR EARNINGS THE CREATOR HAS EARNED IN ACCORDANCE WITH THESE PROGRAM TERMS. THE CREATOR AGREE THAT ALL CLAIMS MADE HEREUNDER BY THE CREATOR AGAINST US WILL BE MADE WITHIN 120 DAYS OF THE ACT OR OMISSION THAT FORMS THE BASIS OF SUCH CLAIMS.
THE CREATOR UNDERSTAND AND AGREE THAT ALL RIGHTS UNDER SECTION 1542 OF THE CIVIL CODE OF CALIFORNIA AND ANY SIMILAR LAW OF ANY STATE OR TERRITORY OF THE UNITED STATES ARE HEREBY EXPRESSLY WAIVED BY HIM/HER. SECTION 1542 READS AS FOLLOWS:
"CERTAIN CLAIMS NOT AFFECTED BY A GENERAL RELEASE. A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN THEIR FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED THEIR SETTLEMENT WITH THE DEBTOR."
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE CREATOR AGREE TO DEFEND, INDEMNIFY AND HOLD MAKERWORLD PARTIES HARMLESS FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, COSTS AND EXPENSES, INCLUDING ATTORNEYS’ FEES, ARISING FROM OR RELATED TO THE CREATOR'S PARTICIPATION IN THE PROGRAM.
THIS PROGRAM, INCLUDING ANY SUBSCRIPTIONS AND PROGRAM MODELS, ARE MADE AVAILABLE ON AN "AS IS," "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AND THE MAKERWORLD PARTIES MAKE NO WARRANTIES, REPRESENTATIONS, OR GUARANTEES OF ANY KIND, WITH REGARD TO THE PROGRAM, THE OPERATION AND MAINTENANCE OF THE PROGRAM, WHETHER EXPRESS OR IMPLIED, ARISING BY LAW OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT OR ANY IMPLIED WARRANTY ARISING FROM COURSE OF PERFORMANCE, COURSE OF DEALING, OR USAGE OF TRADE. WITHOUT LIMITING THE GENERALITY OF FOREGOING, THE MAKERWORLD PARTIES MAKE NO REPRESENTATION THAT THE OPERATION OF THE PROGRAM AND RELATED PRODUCTS OR SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.
THE MAKERWORLD PARTIES ASSUME NO RESPONSIBILITY, AND WILL NOT BE LIABLE, FOR ANY DAMAGES TO, OR ANY VIRUSES OR MALWARE THAT MAY INFECT THE USER'S COMPUTER, TELECOMMUNICATION EQUIPMENT, OR OTHER PROPERTY CAUSED BY OR ARISING FROM PARTICIPATION IN THE PROGRAM, OR THE USER'S DOWNLOADING OF ANY PROGRAM MODELS, INFORMATION OR MATERIALS FROM THE SERVICES.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU DEPENDING ON THE JURISDICTION.
BY PARTICIPATING IN THE PROGRAM, YOU WAIVE AND RELEASE THE MAKERWORLD PARTIES FROM ANY AND ALL LIABILITY FOR ANY INJURIES OR DEATH, OR ANY LOSS OR DAMAGE OF ANY KIND, ARISING FROM OR IN CONNECTION WITH (I) YOUR PARTICIPATION IN THE PROGRAM OR ACCESS TO OR USE OF THE MAKERWORLD PLATFORM; (II) ANY PROGRAM MODELS YOU UPLOAD TO OR OBTAIN FROM THE MAKERWORLD PLATFORM, INCLUDING WITHOUT LIMITATION ANY ACTUAL OR ALLEGED VIOLATION OR MISAPPROPRIATION OF THE INTELLECTUAL PROPERTY OR OTHER RIGHTS OF ANY THIRD PARTY, OR (III) RECEIPT OR USE AND/OR MISUSE OF ANY PLATFORM MODELS PROVIDED OR RECEIVED UNDER THE PROGRAM.
YOU FURTHER AGREE THAT YOU WILL DEFEND, INDEMNIFY, AND HOLD THE MAKERWORLD PARTIES HARMLESS FROM AND AGAINST ANY CLAIM OR DEMAND MADE BY ANY THIRD PARTY, AND ANY RELATED LIABILITY, DAMAGE, LOSS, AND EXPENSE (INCLUDING COSTS AND ATTORNEYS’ FEES) DUE TO, ARISING OUT OF, OR IN CONNECTION WITH: (I) YOUR PARTICIPATION IN THE PROGRAM OR ACCESS TO OR USE OF THE MAKERWORLD PLATFORM; (II) ANY PROGRAM MODELS YOU UPLOAD TO OR OBTAIN FROM THE MAKERWORLD PLATFORM, INCLUDING WITHOUT LIMITATION ANY ACTUAL OR ALLEGED VIOLATION OR MISAPPROPRIATION OF THE INTELLECTUAL PROPERTY OR OTHER RIGHTS OF ANY THIRD PARTY, (III) RECEIPT OR USE AND/OR MISUSE OF ANY PLATFORM MODELS PROVIDED OR RECEIVED UNDER THE PROGRAM; (IV) YOUR BREACH OF THIS AGREEMENT; (V) ANY TAXES THAT YOU MAY OWE AS A RESULT OF YOUR PARTICIPATION IN THE PROGRAM; OR (VI) ANY ACTUAL OR ALLEGED VIOLATION OF LAW.
MakerWorld can terminate or suspend your account in MakerWorld’s sole discretion. MakerWorld also reserves the right to cancel Subscriptions, Subscribers, Membership Levels and descriptions, and remove Program Models for any reason. Additionally, in the event we determine in our discretion that you may be in violation of this Agreement, MakerWorld reserves the right to independently assess the situation and may take any or all of the following measures at its discretion, without limiting any other rights MakerWorld may have under this Agreement or applicable law:
MakerWorld may prohibit you from further participation in the Program (as a Creator or User), or remove any Subscriptions or Membership Levels that you offer or subscribe to as part of the Program.
MakerWorld may take down any relevant Program Models from MakerWorld.
MakerWorld may revoke up to all Creator Earnings earned in any programs on MakerWorld.
9.4.1Account may be banned from any or all programs applications for 30 calendar days.
9.4.2 Repeat offenders may be suspended from any or all programs applications permanently.
We may permanently terminate your account. In such cases:
9.5.1 Any of the Creator’s Program Models under the account will be removed from MakerWorld;
9.5.2 All points, Subscriptions, and other benefits associated with your account will be lost;
9.5.3 The account will no longer be able to upload models, offer or subscribe to Subscriptions, or otherwise engage in any activities on MakerWorld; and
MakerWorld shall bear no responsibility for any consequences arising from the inability to use your account and related services, or the inability to access assets or other rights associated with their account following termination. MakerWorld may reinstate your account in its sole discretion.
For actions suspected of violating laws and regulations or suspected criminal activities, MakerWorld will retain relevant records and reserves the right to report the matter to the competent authorities, cooperate with the investigation by the relevant authorities, and file a report with law enforcement agencies. MakerWorld also reserves the right not to restore any content that has been taken down
This Agreement terminates when any of the following conditions are met:
The Agreement automatically terminates upon termination of the Terms of Use of MakerWorld, including (without limitation) if the Creator closes their account or if their account is suspended or terminated pursuant to this Agreement, the Terms of Use, or Community Guidelines of MakerWorld, or if you cease participation in the Program.
In the event of significant business adjustments or other matters that MakerWorld deems necessary, MakerWorld has the right to terminate the Program with a written notice 30 days in advance in accordance with the methods specified in section 11 of this Agreement.
If the Creator breaches this Agreement, MakerWorld has the right to immediately terminate this Agreement, without limitation of MakerWorld’s other rights or remedies available under applicable law.
The occurrence or fulfillment of other termination conditions under the Agreement.
The following sections will survive any termination of this Agreement : 3.2(Intellectual Property Requirements), 3.4 (Program Model License), 7 (Limitations of Liability), 8 (Indemnification), 9 (Consequences of Breach of Agreement), and 10-13. (Termination and Transfer, Notification and Service, Governing Law and Venue, Miscellaneous).
MakerWorld has the right to transfer or assign all of its rights and obligations of this Agreement to MakerWorld's affiliates without the Creator's prior consent. At that time, MakerWorld will send the Creator's a transfer or assignment notice through website announcements and other means.
MakerWorld can send all notifications to Creators and Subscribers through web announcements, emails, System notification, or regular mail delivery. Such notifications are deemed to have been delivered to the recipient on the date of sending.

The validation, interpretation, modification, fulfilment, and dispute settlement of this Agreement are governed by the laws of Singapore. If any dispute arises concerning the content or performance of this Agreement, the dispute shall be settled through friendly negotiation.
In the event that the dispute cannot be settled through negotiation, either party could submit the dispute to Singapore International Arbitration Centre (SIAC) for arbitration which shall be conducted in accordance with the SIAC's arbitration rules in effect at the time of applying for arbitration. The arbitral tribunal shall consist of three (3) arbitrators. MakerWorld and the Creators shall be entitled to appoint one arbitrator, and the third arbitrator shall be jointly appointed by SIAC. The language of the arbitration is English and is conducted in Singapore city. All arbitrators must be proficient in English. The arbitral award is final and binding upon both MakerWorld and the Creator.
MakerWorld is not and will not be party of any legal actions caused by the services and content provided or promised by a Creator or any conducts implemented by a User, such as Subscription, Membership Level, promise of the Creators or any license between the Creators and Subscribers.
You are responsible for compliance with applicable international laws and regulations relating to export control, economic sanctions, or other laws or regulations applicable to you, including, but not limited to, those of China, the European Union, the United Nations and all United States Export Administration Laws and Regulations, the United States Treasury Department, the Office of Foreign Assets Control ("OFAC") or other similar laws ("Export Control Laws"). Any export or re-export of Program Models or any other material, by you, directly or indirectly, in contravention of any Export Control Laws is prohibited. You are responsible for obtaining any required export authorizations, government approvals and licenses required by any Export Control Laws. You may not download or upload Program Models, or enroll in any Programs where such actions will result in your or MakerWorld’s violation of Export Control Laws. By accessing or using the MakerWorld Platform, you represent and warrant that you are not a citizen or resident of, and are not customarily resident in, any country or region that is subject to an embargo by the United States government or the European Union, that you are not listed as a sanctioned party on the list of specially designated nationals and blocked persons maintained by the United States (including OFAC) or similar sanction lists maintained by the European Union and other applicable governments and that you are purchasing and will use the Products and Services in compliance with all laws governing export control.
Nothing in the Agreement shall constitute or construe any partnership, joint venture, or agencies, etc. between the Parties.
The Creators and Subscribers acknowledge and agree that MakerWorld shall not constitute or be construed as a party of their Subscription, Membership Level, promise of the Creators or any license between the Creators and Subscribers, and bear any obligations or liabilities incurred by it.
This Agreement supersedes all previous oral or written communications between the Parties with respect to the subject matter of this Agreement.
